MarketMigo Terms of Service (International)
The English Terms control. A complete Spanish convenience translation is available. Mandatory language and consumer rights remain unaffected.
1. Who we are
These Terms of Service (the "Terms") are a binding agreement between you and Juan Pablo Padrón Elenes, an individual (sole proprietor) based in Mexico who operates the online service known as "MarketMigo" (the "Provider," "MarketMigo," "we," "us," or "our"). MarketMigo is a trade name; it is not a separate company or legal entity, and we do not claim it is a registered trademark. We operate MarketMigo from Mexico and sell and provide it online only, to business customers in many countries, except the restricted territories described in Section 3. Sales, demos, onboarding, and support are provided remotely (by email, video call, or in the Service). We have no office, employees, or other physical presence outside Mexico, and we do not provide in-person services.
Provider: Juan Pablo Padrón Elenes, an individual (persona física), acting in his own name under the trade name MarketMigo. Mexican address for notices and complaints: Prolongación Vista Hermosa 32, C.P. 05320, Ciudad de México, México. Contact phone: +525527602358. Support and legal notices: support@marketmigo.com. Website: https://www.marketmigo.com. The address is a legal contact address; services and support are provided remotely.
2. Invite-only beta
MarketMigo is currently offered online as an invite-only beta, beginning November 9, 2026, starting with businesses in the Dallas–Fort Worth area of Texas, United States. During the beta (expected to run until the public launch, currently planned for January 26, 2027):
- access is by invitation only, and we may limit the number of accounts, countries, regions, or features;
- features, limits, and workflows may change, be added, or be removed, and the Service may have bugs, interruptions, or data errors;
- we may ask for your feedback, and we may contact you about your experience;
- we expect to publish updated Terms before the public launch and will ask you to accept them as described in Section 22.
Paid plans during the beta are billed as described in Section 11 unless your invitation states otherwise in writing.
3. Business use only; eligibility; territory
MarketMigo is a business-to-business service for businesses and other organizations, and for individuals acting for their trade, business, or profession. It is not offered to consumers or for personal, family, or household use. By creating an account, you represent that:
- by accepting these Terms, you confirm you are at least 18 years old and able to form a binding contract;
- you use the Service for business purposes;
- if you accept these Terms for a business or other organization, you are authorized to bind it, and "you" includes that organization;
- neither you nor the business or organization you act for is located or established in a member state of the European Union, another country of the European Economic Area (EEA), the United Kingdom, or Switzerland (together, the "Restricted Territories"); and
- you are not located in, or owned or controlled by anyone in, a country or territory, or on a list, subject to comprehensive sanctions or export restrictions of Mexico, the United States, the United Nations, the European Union, or the United Kingdom.
Territory. The Service is not offered to, and accounts may not be created by, customers located or established in the European Union, the EEA, the United Kingdom, or Switzerland. We do not market or direct the Service to those places. We may ask for information to confirm where you are located or established (for example, your billing country), and we may refuse any sign-up, subscription, or order, and suspend or close any account, if we reasonably believe the customer is located or established in a Restricted Territory or that a statement made in this Section is untrue.
4. Accepting these Terms; electronic records
You accept these Terms by checking the box, which is unticked by default, and selecting "Create account" (or, if you sign up through a third-party sign-in such as Google, by checking the same box before you continue). If you join through a workspace invitation or an account we prepared for you online, you accept on the activation screen before first use. You agree that electronic signatures, checkboxes, and records have the same effect as signed paper documents, to the extent permitted by applicable law (including Mexico's Commercial Code provisions on electronic commerce and, where they apply, laws such as the US E-SIGN Act and the Uniform Electronic Transactions Act).
We keep a record of the version you accepted, its date and content hash, the language shown, the acceptance wording, and the server timestamp. Acceptance is never inferred from silence. Accepting these Terms confirms that you are 18 or older and includes service usage analytics and the featuring/staff-review permission in Section 10, subject to your account setting and any earlier withdrawal. Marketing email and browser notifications remain separate optional choices. Material updates require the express acceptance described in Section 22.
5. Accounts and security
- Provide accurate information and keep it current.
- Keep your credentials and devices secure. You are responsible for activity in your account and workspace, including activity by members you invite, except unauthorized use you report promptly.
- Tell us immediately at support@marketmigo.com if you suspect unauthorized access or misuse.
6. The Service
MarketMigo is an AI marketing workspace for local businesses. It helps you organize brand, product, promotion, and media records; create and review AI-assisted posts, Stories, captions, and images; manage assets, calendars, and approvals; publish to connected social accounts; and review analytics, all within your plan's usage limits. The in-product description and your plan determine which features are included.
Some features depend on credentials, permissions, platform review, plan limits, or additional setup. A feature marked beta, coming soon, pending verification, disabled, or unavailable is not a delivery commitment until it is enabled for your account. MarketMigo does not currently offer AI video generation, a TikTok connection, paid Meta ads, Google Business Profile management, or website creation. Any mention of those features describes a possible future feature and is not part of what you buy.
No invented metrics. Our core commitment is that MarketMigo does not invent performance numbers. The statistics MarketMigo shows or puts into content come only from (a) facts you provide about your business, (b) data received through official platform APIs, or (c) screenshots you upload and confirm. If we cannot verify a number from one of those sources, we will not present it as a measured result. You agree not to edit or present content in a way that defeats this commitment, for example by adding unsupported claims, reviews, or results.
7. Your control and responsibilities
You keep final editorial and business control. Before you publish or use content, you are responsible for reviewing it and checking its facts, prices, promotions, availability, dates, claims, required disclosures, the rights to any people, brands, or images in it, and its compliance with the laws and platform rules of every place where you publish or advertise. This includes truth-in-advertising, consumer-protection, and endorsement rules (for example, in the United States the FTC Act, the FTC Endorsement Guides, and the FTC rule on fake reviews and testimonials; and in Mexico the Federal Consumer Protection Law), and rules for sweepstakes, regulated industries, privacy, and intellectual property.
Your inputs and context. You are responsible for the prompts, instructions, business details, claims, files, images, and other context you provide, and for the posts and other content you choose to use or publish. Check that your inputs are accurate, lawful, and authorized. An AI suggestion or automated check does not verify your rights or transfer your editorial responsibility to MarketMigo.
Review and automation. You can review, edit, approve, or reject content before publishing it. If you enable an automatic mode or publishing workflow that does not require approval of each post, you authorize that workflow to act within the settings and instructions you choose. It may publish without asking you to approve each item. You remain responsible for those choices, monitoring the workflow, reviewing the resulting content, and pausing or changing automation when needed. Enabling automation does not transfer responsibility for your inputs, context, or publications to MarketMigo.
No MarketMigo suggestion, score, or automated check replaces your own judgment or legal, tax, financial, medical, or other professional advice.
8. AI-generated content
MarketMigo uses third-party AI models, currently provided by OpenAI, to generate text and images. AI output can be inaccurate, incomplete, biased, offensive, non-unique, similar to third-party material, or not protectable by copyright. We do not warrant that output is accurate, original, exclusive, non-infringing, lawful, or acceptable to any platform. Review output before you use it, label AI-generated or synthetic content where law or platform rules require it, and do not put unnecessary sensitive personal information, confidential material, or third-party content you lack rights to into prompts or uploads.
Images and third-party rights. You must obtain and verify all copyrights, licenses, permissions, releases, and other rights needed to upload, process, adapt, publish, or otherwise use an image or other material. This applies whether you supply it, import it from a website or connected account, or the AI or Service finds, retrieves, suggests, edits, or generates it. Material being publicly accessible, appearing in search results, or being returned by AI does not establish permission to use it. Do not use material unless you have the necessary rights; replace or remove it if you cannot verify them. We do not clear third-party rights on your behalf.
Responsibility for output. You are responsible for evaluating AI output and deciding whether to approve, use, or publish it, including through automation you authorize. Subject to the mandatory exceptions in Section 18 and to the fullest extent permitted by law, MarketMigo is not responsible for claims, infringement, harm, or losses arising from your inputs or context, material you lack rights to, or your approval, use, or publication of AI output. The same applies when the AI or Service finds or generates the material. AI output does not represent MarketMigo's endorsement. These provisions do not exclude our own obligations or liability that cannot lawfully be excluded.
AI requests may involve automatic transport retries or application retries, quality checks, failed or incomplete responses, and calls stopped before contacting the provider. We record usage and technical outcomes as explained in Section 24. An attempted generation is not a promise of usable output. We send the content needed for a requested AI feature to the AI provider; the exclusions from PostHog telemetry in Section 24 do not mean that no provider ever processes your content.
9. Publishing to Instagram and Facebook; Meta platform terms
MarketMigo can publish automatically to Instagram (feed and Stories) and to Facebook Pages through Meta's official APIs. Facebook Page publishing is available to all users. We may pause automatic publishing for all or some accounts at any time (for example, if Meta changes its APIs or we detect a problem). When you connect an account, schedule a post, or turn on automation, you instruct and authorize us to send the selected content to the destinations you chose, at the times you chose, and to read the account data and insights needed to do so. You represent that you are authorized to manage each connected account.
- Your use of Instagram and Facebook remains subject to Meta's terms, policies, and community standards, including the Meta Platform Terms. You are responsible for complying with them.
- You may cancel a future scheduled action while the Service can still stop it. We cannot recall a post that Meta has already accepted.
- A draft, calendar entry, or "scheduled" status is not proof of publication. Only a success response from the platform means we received confirmation, and the platform may still delay, limit, moderate, or remove content.
- We do not control Meta's outages, API changes, reviews, rate limits, moderation, reach, account restrictions, or metrics. You can revoke our access at any time in MarketMigo or in your Meta account settings.
10. Your content; featuring and staff review
You keep ownership of everything you submit or create with the Service, including brand materials, prompts, photos, files, drafts, posts, and the AI output generated for you, to the extent any rights exist in it ("Customer Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, copy, process, adapt, transmit, and display Customer Content only as needed to provide, secure, maintain, and support the Service for you and as described in our Privacy Policy. This license ends when your Customer Content is deleted, except for lawful retention and backups. You represent that you have all rights and permissions needed for Customer Content.
Featuring and staff review are included in your Terms acceptance. By accepting these Terms, you authorize MarketMigo staff to review posts in businesses you own and grant a non-exclusive, royalty-free, revocable permission to feature your business name, logo, and posts created with MarketMigo in our own social media, website, and emails. This does not authorize disclosure of private account data or performance numbers, or training AI models on your content. You must hold the rights needed for the material you provide.
Account control. Turn off Feature posts and allow staff review in Settings or Account to block future featuring and staff access to your AI creations, including Calendar support and prepared-account images. This account preference applies to every business you own and across devices. Automated generation, quality checks, storage, and publishing you request continue. We preserve any earlier decline or withdrawal when you accept an update. New accounts receive this permission through their Terms acceptance; there is no separate publicity checkbox.
Withdrawal. Turning the setting off stops new uses and removes retained provider diagnostic envelopes. Contact support@marketmigo.com to request removal of an existing feature. We cannot recall copies others have already shared. Mandatory privacy rights and lawful retention remain unaffected.
11. Plans, free trial, billing, and taxes
Prices. Prices are in US dollars (USD). Essential: $49 per month or $499 per year. Growth: $149 per month or $1,499 per year. Plan limits on annual plans reset every month. Before you buy, we show the price, billing frequency, the first charge amount and date, the included limits, and that the plan renews automatically.
Taxes. Prices include applicable taxes unless stated otherwise at checkout. The total shown at checkout before you pay is the amount charged for each billing period. If you pay from outside the United States, your bank or card issuer may charge currency-conversion or foreign-transaction fees, which we do not control.
Free trial. We may offer a free 7-day trial. It requires a valid payment method entered on Stripe's secure checkout page. Trial features and usage may be limited, and each user, business, and connected social account may receive only one trial. Unless you cancel before the trial ends, your payment method will be charged automatically for the plan and billing period you selected, and the subscription will renew until you cancel. We will email you a reminder on day 4 of the trial, about 3 days before the first charge. If you cancel during the trial, you will not be charged.
Automatic renewal. Subscriptions renew automatically at the end of each monthly or annual period at the then-current price, and your payment method is charged unless you cancel before the renewal date. By starting a subscription, you authorize these recurring charges. We will email you 5 days before each paid renewal, monthly or annual, with the amount and the charge date. We will give you at least 30 days' notice of any price increase, and it will take effect at your next renewal.
Payments. Payments are processed by Stripe. At checkout, we collect your payment method (through Stripe) and your full billing address, and you may add a business tax ID. We do not receive or store your full card number. If a payment fails, Stripe may retry it and paid features may pause. If the retries fail, the subscription is canceled without a penalty.
Usage and cost statistics. Plan quotas, usage records, and internal provider-spend controls support delivery and prevent abuse. AI cost figures in operational analytics are estimates based on reported usage and applicable model prices; unknown costs remain unknown. Retries may create additional provider work. Attempt events do not add a second copy of the same reported token cost. These statistics do not authorize extra customer charges, change your agreed price, or replace Stripe billing records or provider invoices. We disclose and obtain any authorization required for a separately priced purchase before charging it.
12. Cancellation and refunds
You can cancel at any time, without penalty, from Plan & billing ("Manage subscription") or by emailing support@marketmigo.com. Cancellation stops all future charges, and we confirm it by email with a reference number. You keep access until the end of the period you have already paid for, unless you choose to end access immediately, for example by deleting your account.
Refunds. Fees are non-refundable except where applicable law requires a refund. Duplicate charges are always refunded. Any other refund or credit is at the Provider's sole discretion, and granting one does not oblige us to grant others.
13. Communications and marketing email
By creating an account, you agree to receive transactional and relationship messages by email and in the Service, such as security alerts, billing notices, trial and renewal reminders, and notices of changes to these Terms. These messages are necessary for the Service, and you cannot opt out of them while your account is active.
Marketing email is optional and opt-in. On the sign-up page there is a separate, optional checkbox: "Send me product news and marketing tips by email. (optional)" It is unticked by default, and leaving it unticked does not affect your account or your access to the Service. You can turn marketing email on or off at any time in your account's email notification settings. We send promotional or marketing email only if you ticked that box, and only as allowed by the anti-spam laws that apply to you (for example, the US CAN-SPAM Act, and Canada's Anti-Spam Legislation). Each promotional message identifies MarketMigo as the sender, uses accurate headers and subject lines, includes a valid physical postal address for the sender, and has a working one-click unsubscribe link in every marketing email that works without signing in. We honor unsubscribe requests within 10 business days, and usually immediately. You can also unsubscribe by emailing support@marketmigo.com. If you use MarketMigo content in your own email, text, or social marketing, you are responsible for complying with the anti-spam, telemarketing, and similar laws that apply to you.
14. Acceptable use
You will not, and will not allow others to:
- break any law, infringe or misappropriate anyone's rights, or violate sanctions or platform rules;
- create or publish fraud, spam, impersonation, malware, harassment, hate, or sexual content involving minors; deceptive advertising; or fake reviews, testimonials, endorsements, or metrics;
- use anyone's likeness, voice, brand, data, or credentials without permission, or hide required AI, advertising, or sponsorship disclosures;
- get around usage limits, security, approvals, workspace isolation, or publishing permissions;
- probe, scrape, overload, reverse engineer, resell, or interfere with the Service, except where law expressly allows it; or
- use the Service to build a competing product, or to train AI models on our outputs or software.
15. Our property and feedback
We and our licensors own the Service, including its software, designs, documentation, and models (but not Customer Content). Subject to these Terms and your plan, we grant you a limited, non-exclusive, non-transferable right to use the Service while your account is active. If you send us suggestions or feedback, we may use them without payment or attribution, and we will not identify you publicly without your permission.
16. Suspension, termination, and your data
We may suspend or limit access if reasonably necessary to protect people or systems, investigate abuse, comply with law, prevent unauthorized spending, address non-payment, or respond to a breach of these Terms. When practical, we will notify you first and give you a chance to fix the problem. We may end the beta or close beta accounts with reasonable notice.
You can stop using the Service at any time. You can export your available data and request account deletion from your account (https://www.marketmigo.com/account/deletion) or by emailing support@marketmigo.com. After termination, your license ends, and sections that by their nature should survive will survive, including those on fees owed, ownership, disclaimers, limitation of liability, indemnity, data protection, and disputes.
17. Disclaimer of warranties
THE SERVICE, INCLUDING BETA FEATURES AND AI OUTPUT, IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, THE PROVIDER DISCLAIMS ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; THAT CONTENT WILL BE PUBLISHED OR ACCEPTED BY ANY PLATFORM; OR THAT YOU WILL ACHIEVE ANY REACH, FOLLOWERS, SALES, REVENUE, OR OTHER BUSINESS RESULTS.
18. Limitation of liability
Exclusion of indirect damages. TO THE FULLEST EXTENT PERMITTED BY LAW, THE PROVIDER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, OPPORTUNITY, OR DATA, EVEN IF ADVISED OF THEIR POSSIBILITY.
Liability cap. TO THE FULLEST EXTENT PERMITTED BY LAW, THE PROVIDER'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED US DOLLARS (USD $100).
Scope. The exclusion and the cap apply to every theory of liability, including contract, tort (including negligence), strict liability, statute, and warranty, and apply even if a limited remedy fails of its essential purpose. They reflect an agreed allocation of risk that is reflected in our prices.
Exceptions. Nothing in these Terms excludes or limits (a) liability for fraud or fraudulent misrepresentation, willful misconduct (dolo), or gross negligence; (b) liability for death or personal injury caused by negligence; (c) your obligation to pay the fees you owe; or (d) any other liability that cannot be excluded or limited under applicable law. Where the law limits the extent to which liability can be excluded or capped, our liability is excluded or capped only to the maximum extent the law allows.
19. Indemnification
You will defend, indemnify, and hold harmless the Provider from third-party claims, and from the resulting losses and reasonable legal fees, that arise from your Customer Content, your instructions or publications, your use of connected accounts, your violation of law or third-party rights, or your breach of these Terms. This does not apply to the extent a claim is caused by the Provider's own negligence, willful misconduct, or breach. We will notify you promptly of a claim and let you control its defense, but you may not settle a claim that imposes obligations on us without our consent.
20. Governing law and disputes
Informal resolution first. Each party should email the other a description of a dispute (to us at support@marketmigo.com) and try to resolve it in good faith for 30 days. This process does not prevent a complaint to PROFECO or another competent authority, urgent relief, or action needed to preserve a legal deadline, and does not limit any mandatory right.
Governing law. These Terms, and any dispute arising from or relating to them or the Service, are governed by the laws of the United Mexican States (Mexico), including applicable federal commercial law, without regard to conflict-of-laws rules. The UN Convention on Contracts for the International Sale of Goods does not apply.
Courts. Any dispute that is not resolved informally will be submitted exclusively to the competent courts of Mexico City (Ciudad de México), Mexico. Each party expressly submits to those courts and waives any other jurisdiction that may apply to it because of its present or future domicile or for any other reason. Either party may seek urgent injunctive relief to protect its intellectual property or the security of the Service in any competent court.
Mandatory rights. Nothing in this Section removes any protection that the mandatory law of your country, state, or province gives you and that cannot be waived by contract.
21. Third-party services
The Service relies on third-party services, including Meta (Instagram and Facebook), Stripe, OpenAI, Supabase, Vercel, Resend, Grafana, and PostHog. Where you have a direct relationship with a third party, its terms govern that relationship. We remain responsible for our own obligations and for any responsibility the law does not allow us to exclude; third-party terms do not waive those obligations. Their outages or changes may affect availability. If a third party changes or withdraws a service we rely on, we may change or discontinue the related feature.
22. Changes to these Terms
Material update 2026-11-09-v4: Clarifies your responsibility for inputs and context, image and third-party rights even when AI finds or generates material, review of AI output, and automatic publishing you authorize. The age, service analytics, featuring, and staff-review terms introduced in v3 remain in place, including the account control to disable featuring and staff review.
We may update these Terms as the Service or the law changes. We will post each new version with its date and a summary of changes. For a material change, such as a change to price, renewal, cancellation, liability, dispute resolution, or data use, we will give reasonable advance notice by email or in the Service, and we will ask you to accept the new version before you continue using the Service. The change applies going forward only. If you do not accept, you may cancel without penalty and export your data. Non-material changes, such as corrections or new contact details, take effect when posted.
23. General
- Entire agreement. These Terms and any order or written offer we accept form the agreement on the Service. The Privacy Policy provides the required information about personal-data processing and supplements Section 24; acknowledging it is not blanket consent to optional purposes or a waiver of privacy rights.
- Language. The Service is available in English and Spanish. These Terms are published in English, and the English version controls. A complete Spanish convenience translation is available at https://www.marketmigo.com/terms?lang=es and the English text at https://www.marketmigo.com/terms?lang=en. The English text controls differences, except where mandatory law requires Spanish or gives effect to the Spanish text. Neither language clause limits mandatory rights or complaints to a competent authority.
- Severability and waiver. If a provision is unenforceable, it will be limited to the minimum extent necessary, and the rest remains in effect. Failing to enforce a provision is not a waiver.
- Assignment. You may not assign these Terms without our consent. We may assign them, with notice, in connection with a reorganization, an entity formation, or a sale of the Service.
- Force majeure. Neither party is liable for a delay caused by events beyond its reasonable control, except for payment obligations.
- Notices. We may send you notices by email or in the Service. You may send notices, including formal legal notices, by email to support@marketmigo.com.
- Relationship. The parties are independent contractors, and these Terms create no third-party beneficiaries.
- Export and sanctions. You will comply with the export-control and sanctions laws that apply to you and to the Service.
24. Data protection, tracking, and statistics
24.1 Roles, purposes, and customer instructions
Our Privacy Policy at https://www.marketmigo.com/privacy explains the categories of personal information, sources, purposes, recipients, international processing, retention, and rights. We are responsible as controller for account administration, security, our own billing, legal records, and the operation of MarketMigo. Processing necessary to provide the Service, meet legal duties, or protect its security is distinct from service analytics and optional marketing-email purposes. We rely on the grounds applicable to each purpose under the applicable law; these Terms are not a waiver of consent requirements or data-protection rights.
When we process personal information contained in Customer Content on your behalf (for example, photos or testimonials of your customers), we act as your processor or service provider. We will process it only to provide the Service and on your documented instructions (these Terms and your use of the Service); keep it confidential and restrict access to people who need it; apply the security measures described in the Privacy Policy; use the subprocessors listed there and notify changes; help you respond to individuals' requests and meet security and breach duties; notify you without undue delay after we become aware of a breach affecting it; delete it at the end of the Service as described in the Privacy Policy, subject to lawful retention; and provide information reasonably needed to show compliance. You must have the necessary rights, lawful basis, and notices for the personal information you provide, including images and testimonials of other people.
24.2 Service records and statistics
MarketMigo keeps records needed to operate your account and workspace, including sign-in and security activity, roles and invitations, settings and consent choices, contractual acceptance, content and approvals, connected-channel permissions and publishing receipts, feature requests and errors, quotas and consumption, AI usage and spending controls, subscription and invoice status, support, email delivery, and authorized notification delivery. Those internal records may be linked to your account or workspace. Customer Content, including prompts, uploads, and generated output, may be stored or processed inside the Service and sent to the provider needed for the feature. The PostHog exclusions below apply to that telemetry, not to all internal service records or necessary AI processing.
We use these records for the requested features, account and billing administration, support, security, fraud and abuse prevention, reliability, and legal obligations, as described in the Privacy Policy. Connected-social-account performance statistics come from authorized platform data or evidence you provide. Internal product-use statistics describe use of MarketMigo, not your audience's behavior outside the connected data you authorized.
24.3 Service usage analytics with PostHog
Service usage analytics is included in these Terms. After your signed-in account accepts the current Terms and Privacy Policy, browser analytics sends PostHog visits to known product routes; generic button, link, and form-submission counts; feature-request route templates, method, HTTP status, outcome, and duration; coarse device and interface-language categories; Web Vitals (CLS, FCP, INP, LCP, and TTFB); and generic browser-error categories. It measures product use and performance so we can improve MarketMigo.
We replace record identifiers in eligible page and API paths with fixed templates. This collection does not read form values, DOM text, request or response bodies, or error messages, and excludes private content, account details, query parameters, URL fragments, referrers, campaign tags, session recordings, and heatmaps. Automatic DOM capture and person profiles are disabled. Random identifiers are temporary and held in memory, rather than being persistent account identifiers.
There is no separate analytics checkbox or banner. Browser collection stops when you sign out or current acceptance cannot be verified. Do Not Track and Global Privacy Control remain respected. Contact support@marketmigo.com to exercise applicable objection or withdrawal rights. Requests already sent cannot be recalled and remain subject to the Privacy Policy and your applicable rights.
24.4 Server monitoring, AI attempts, failures, and costs
Separately from browser analytics, our servers send PostHog limited technical events to monitor reliability, diagnose failures, prevent unauthorized spending, and maintain AI features and scheduled workflows. These include:
- AI calls: model and provider, product feature, text or image call type, credential category without keys, trigger type, completion or failure status, HTTP status, duration, application retry count, transport-attempt count and SDK retries, and generic failure categories.
- Text and image usage: reported input, output, cached, reasoning, and text/image token counts; image generation or editing, quality, dimensions, requested and returned image counts; and web-search call counts where reported. No prompt text, generated text, image bytes, or tool contents are included in this telemetry.
- Retries and skipped work: a random identifier can associate attempts within the same provider call. Individual transport attempts record status and timing without duplicating the call's token cost. Guard events can record that work was skipped before a provider call, its generic reason, and zero provider cost for that skipped call. Failed or incomplete work may have consumed provider resources; missing usage or cost is not treated as a measured zero.
- Costs: estimates based on provider-reported usage and model prices, with unavailable costs marked as unknown. Internal reservations or spending envelopes are not represented as measured provider costs. These estimates support operations and do not create a separate customer payment obligation (Section 11).
- Reliability: outcomes, HTTP status, and duration for authorized scheduled workers, and generic unhandled server-error events with fixed route templates and error categories.
This PostHog telemetry excludes prompts, responses, images, tool contents, credentials, raw error messages, and account or workspace identifiers. Random identifiers relate calls and attempts, rather than establishing customer profiles. The account content-privacy preference does not switch off this content-free server monitoring or the internal records needed to provide and secure the Service. This distinction does not remove any right to object, request deletion, limit processing, or withdraw consent where the applicable law provides one.
24.5 Providers, technical metadata, and measurement limits
PostHog processes this telemetry in its United States cloud. Grafana and the other service providers listed in the Privacy Policy support hosting, logs, storage, authentication, AI, payments, and communications. They can receive technical network metadata necessary for delivery. In particular, a network request to PostHog exposes a source IP address (your browser's public address for browser requests or our server's outbound address for server requests), even though IP-based geolocation enrichment and person profiles are disabled. Temporary identifiers and limited event fields do not guarantee irreversible anonymity. We do not sell this information or use it for cross-site advertising, ad targeting, or eligibility decisions about individuals.
Telemetry delivery is best effort and may be incomplete, delayed, blocked, or duplicated. Counts are not guaranteed to represent unique people or all historical activity. An HTTP success, a submitted request, or a scheduled job alone is not proof of a completed AI result, publication, payment, or business outcome. Provider receipts, application records, and billing records are the relevant evidence for those actions. No reach, engagement, conversion, revenue, or other business result is guaranteed.
24.6 Retention, privacy rights, and future changes
We retain information for the periods and purposes in the Privacy Policy, not indefinitely merely because it was collected. Contractual acceptance and related evidence are retained while the account exists and for ten years after account deletion for commercial record-keeping, tax obligations, and legal claims; access is restricted to those purposes. This does not extend retention of every page view, prompt, image, or workspace record to ten years. Other service records and provider logs follow their applicable, limited retention periods. Where law requires longer retention, records must remain restricted to that legal purpose.
You can use the export, deletion, and preferences controls or contact support@marketmigo.com to exercise applicable access, rectification, cancellation, opposition, consent-withdrawal, and other privacy rights. We verify requests and apply legal exceptions as described in the Privacy Policy. Contract acceptance does not authorize materially different future tracking. We will give notice of changes and obtain a new choice or consent when required before expanding optional collection or changing purposes.
25. Regional terms
These short sections apply only to customers in the places named. If they conflict with the rest of these Terms, they control for those customers.
25.1 United States
- Automatic-renewal disclosures. Before you subscribe, we show clearly and next to the purchase button that the subscription renews automatically until you cancel, the amount and frequency of each charge, the length of any trial and the date of the first charge, and how to cancel. We obtain your express consent to recurring charges, send you a confirmation that repeats these terms and explains how to cancel, and let you cancel online in Plan & billing as easily as you signed up. Reminders are sent as described in Section 11.
- Marketing email. We send promotional email only to users who opted in (on the sign-up page or in their settings), and it complies with the CAN-SPAM Act, including our postal address and a one-click unsubscribe link. If you use MarketMigo content in your own email or text marketing, you are responsible for complying with CAN-SPAM, the TCPA, and similar state laws.
- Electronic records. Section 4 applies under the federal E-SIGN Act and state electronic-transactions laws.
25.2 Mexico
- These Terms are governed by Mexican law as stated in Section 20. Where the Federal Consumer Protection Law (Ley Federal de Protección al Consumidor) applies to you despite the business-only nature of the Service, its mandatory provisions apply, including applicable information, recurring-charge consent, renewal-notice, cancellation, refund, and remedy rights. You may contact PROFECO without completing the informal process in Section 20. Neither our business-only description nor the language, forum, liability cap, indemnity, or refund provisions waive rights that the law makes non-waivable. Our Mexican notice address and phone appear in Section 1.
